The case raises important questions about copyright protection for editorial content \u2014 including material similar in nature and function to content produced by STM\u2019s members.\u00a0The case also presents a\u00a0set of facts\u00a0under which the\u00a0lower court rightly found\u00a0ROSS\u2019s use\u00a0of Thomson Reuters\u2019 product\u00a0was not transformative,\u00a0that\u00a0the\u00a0unpermissioned\u00a0use\u00a0resulted in\u00a0a tool\u00a0that\u00a0directly competed\u00a0with\u00a0Thomson Reuters, and\u00a0which\u00a0did not constitute\u00a0fair use.<\/span><span data-ccp-props=\"{&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The case\u00a0centres\u00a0on Westlaw\u2019s \u201cheadnotes\u201d \u2014 concise editorial summaries created by legal experts to help users navigate case law. ROSS Intelligence, a now-defunct startup, used thousands of these headnotes to train a competing AI-driven legal research tool, without permission. A lower court ruled that the headnotes are protected by\u00a0copyright\u00a0and that ROSS\u2019s copying did not qualify as fair use. ROSS is\u00a0appealing\u00a0the decision.<\/span><span data-ccp-props=\"{&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The\u00a0<\/span><b><span data-contrast=\"auto\">Copyright Alliance\u00a0<\/span><\/b><a href=\"https:\/\/copyrightalliance.org\/wp-content\/uploads\/2025\/11\/2025.11.26-Dkt-112_25-2153_Amicus-Brief-Copyright-Alliance.pdf\"><b><span data-contrast=\"none\">brief<\/span><\/b><\/a><span data-contrast=\"auto\">, which incorporates input\u00a0from STM, argues that Westlaw\u2019s headnotes meet the originality threshold for copyright (not unlike scholarly abstracts, summaries or editorial metadata crafted by STM publishers). It also emphasizes that allowing unlicensed reuse of this kind could undermine the legitimate licensing market for high-quality, curated content \u2014 especially when used to train generative AI tools.<\/span><span data-ccp-props=\"{&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">STM supports the\u00a0brief\u2019s\u00a0position that copyright protects not just personality-laden\u00a0works, but also the intellectual expressive works that involve crafting structured, discoverable, and context-rich editorial material.
